What is a legal notice?
A legal notice communicates a formal demand or warning to another party. It can be relevant to an unpaid amount, an unperformed obligation or another dispute requiring a clear written demand.
ADJD's legal-notice guidance describes notices founded on a legal provision or contractual agreement. The appropriate route depends on the nature of the dispute.
Organise the facts and evidence
Prepare a concise chronology and identify the documents establishing the parties' relationship and the obligation being claimed. Separate facts you can support from assumptions or allegations.
A notice should allow the recipient to understand what happened and what is being requested.
- Correct names and identity or company details
- Agreement and relevant correspondence
- Payment records or other supporting documents
- The specific demand and its basis
- Available recipient contact and address information
Draft a precise demand
State the obligation clearly and check any amount against the records. Avoid unsupported accusations, threats or claims that an enforcement measure is automatic.
The response period should reflect the applicable law or agreement. A lawyer can advise on a disputed entitlement, the appropriate notice wording and any related deadline.
Submit through the applicable channel
ADJD provides a legal-notice process involving preparation, submission, fees and the authority's review and service steps. Confirm the checklist for the actual application.
Check translation requirements and retain the issued notice, receipts and available evidence of service. Submitting an application is not the same as confirming delivery to the recipient.
What happens after service?
A notice may lead to payment, a response or settlement discussions. It does not itself decide the dispute or guarantee recovery.
If the recipient does not comply, obtain advice on the available next step. A notice should not be assumed to suspend every legal deadline.
